If you want to come to Australia to marry your prospective spouse, then you can apply for Prospective Marriage visa. The prospective spouse must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
This visa is a temporary visa that allows you to stay in Australia for nine months from the date of the grant. When this visa is granted you can enter Australia and you must marry your prospective spouse within the time frame of the visa. This visa cannot be extended or you cannot apply for another Prospective Marriage visa in Australia if you have not yet married to your sponsor. You can work or study on this visa.
Eligibility for Prospective Marriage visa subclass 300
To become eligible for this visa :
- your prospective spouse must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen
- you must be sponsored by your prospective spouse
- you and your prospective spouse have met in person since both of you turned 18
- you and your prospective spouse are genuinely intend to marry and live together as spouse
- you must be outside Australia at the time of application
Pathway to Permanent Residency:
Applicants can apply for Partner Visa (subclasses 820 and 801) after marriage with their prospective spouse.
Limitation on sponsorship
There are some limitations on sponsorship to sponsor an applicant. Department may refuse sponsorship and your partners visa application if :
- You are sponsoring someone for third time for a Partner visa or Prospective Marriage visa or
- You have sponsored another partner within the last 5 years or
- Someone sponsored you as a partner within the last 5 years.
But sponsorship might still be approved if there are compelling reasons affecting sponsor
