If you are in Australia and you are a spouse or de facto partner of an Australian citizen, an Australian permanent resident or an Eligible New Zealand citizen, then you can apply for Partner visa (subclasses 820 and 801) to live in Australia.
Application is processed in two stages :
- Partner (Temporary) subclass 820
- Partner(Residence) subclass 801.
Partner (Temporary) subclass 820
This is temporary visa for the applicant in Australia who is a spouse or de facto partner of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
Eligibility for Partner (temporary) subclass 820:
To be eligible for this visa ;
- you and your Australian partner should be legally married or in de facto relationship for at least 12 months prior to the application
- you must be in Australia at the time of application
- you must be sponsored by your spouse or de facto partner
- you and your Australian partner have genuine relationship
- You must meet health and character requirements
Partner (Residence) subclass 801
This is a permanent visa that allows you to live and work permanently in Australia.
Eligibility for Partner (residence) subclass 801:
To be eligible for this visa:
- you must hold Partner (temporary) subclass 820
- you must be in Australia at the time of application
- you and your Australian partner have genuine and continuing relationship for 2 years after the grant of Partner (temporary) subclass 820.
- you must be sponsored by your Australian spouse or de facto partner
- You must meet health and character requirements
