If you are a spouse or de facto partner of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen and you are residing offshore, then you can apply for Partner visa (subclasses 309 and 100).
Application is processed in two stages :
- Partner (Provisional) subclass 309
- Partner (Migrant) subclass 100
Partner (Provisional) subclass 309
This is provisional visa for the applicant outside Australia who is a spouse or de facto partner of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
Eligibility for Partner (provisional) subclass 309:
To be eligible for this visa ;
- you and your Australian partner should be legally married or in de facto relationship for at least 12 months prior to the application
- you must be outside Australia at the time of application
- you must be sponsored by your spouse or de facto partner
- you and your Australian partner have genuine relationship
- You must meet health and character requirements
Partner (Migrant) subclass 100
This is a permanent visa that allows you to live and work permanently in Australia.
Eligibility for Partner (migrant) subclass 100:
To be eligible for this visa:
- you hold Partner (provisional) subclass 309
- you may be in or outside Australia at the time of application
- you and your Australian partner have genuine and continuing relationship for 2 years after the grant of Partner (provisional) subclass 309.
- you must be sponsored by your Australian spouse or de facto partner
- You must meet health and character requirements
