Employer Nomination Scheme (ENS) Subclass 186

This is a permanent visa for the skilled workers. This visa allows you to live and work permanently in Australia.

This visa can be granted under 3 streams:

1. Temporary Residence Transition Stream
2. Direct Entry Scheme
3. Labour Agreement Stream

1. Temporary Residence Transition Stream:

You will be eligible for this pathway to Permanent Residency if :

• you currently hold a subclass 457, TSS subclass 482 or related Bridging Visa A, B or C
• you have worked for employer for at least 3 years full time in the nominated occupation on subclass 457 visa or TSS visa
• the same employer nominated you for the Employer Nomination Scheme subclass 186
• you must hold license, registration or professional membership if required for the occupation
• you are under 45 years of age or exempt from age criteria
• you have competent English
• you meet the health and character requirement

2. Direct Entry Stream:

This pathway to get permanent residency will suits you if :

• you have been nominated by your employer for the Direct Entry Scheme
• you have relevant skills and qualification for the nominated occupations
• you have been employed in the nominated occupation at least for 3 years on full time basis at the level of skills required for the occupation unless exempt
• the assessing authority has assessed your skills as suitable for the occupation unless exempt
• you must hold license, registration or professional membership if required for the occupation
• you are under 45 years of age or exempt from age criteria
• you have competent English
• you meet the health and character requirement

3. Labour Agreement Stream:

This stream to get ENS subclass 186 visa is for you if :

• you are nominated by your employer in accordance with Labour Agreement
• you have qualification, experience, skills, English Language skills for the nominating position in accordance with labour agreement
• you must hold license, registration or professional membership if required for the occupation
• you are under 45 years of age unless exempt under labour agreement
• you meet the health and character requirement

Steps to apply for Employer Nomination Scheme subclass 186

There are 2 steps involved:

1. Nomination Application: Employer nominates the position that needs to be filled. Employer can only nominates the position if :

• There is genuine need of paid worker for the position
• the business is actively and lawfully operating in Australia
• employer offer a full time position for at least two years
• employer offers market salary rate
• there is no adverse information known about the business

2.  Visa Application: Once the nomination application is lodged, employee can lodge visa application with the department for Employer Nomination Scheme subclass 186 visa.
